Prosperous Nation Limited respects the Personal Data (as defined below) that families and other users entrust to us, and we treat it as our responsibility to manage, protect and process that data properly.

This Privacy Policy (“Policy”) explains how Prosperous Nation Limited (“Prosperous Nation”, “us”, “we” or “our”) collects, uses, discloses and/or processes Personal Data you provide when using our website, our Motok application and any related features or services (together, the “Platform”), or when you deal with us in connection with the same.

Motok is our product: a family AI English speaking tutor for primary and secondary students. By visiting our websites or using Motok or any other application or software we provide from time to time (together, our “App”), you accept and consent to the practices set out below. If you are a parent or guardian setting up Motok for a student, you accept this Policy on your own behalf and on behalf of that student.

1 Collection of information

1.1 For the purposes outlined in Clause 2, we may collect and process the following information about you (and, where you use Motok for a student, about that student):

(a) Information you give us, for example name, address, email address, telephone number, payment details (handled by our payment provider), year group or language level, and other personal information, by filling in forms on our Site or our App, or by corresponding with us, including:
1. (i) when you register an account with us;
2. (ii) when you report any problem to us;
3. (iii) when you use certain features on our Site or our App, including spoken practice, scene exercises and pronunciation scoring;
4. (iv) when you request any support; or
5. (v) when you complete any survey or questionnaire that we send to you.
(b) Voice and learning records created when Motok is used, for example voice recordings, transcripts, pronunciation scores, scene progress, practice history and similar learning records.
(c) Information we collect automatically when you visit our Site or use our App, for example:
1. (i) technical information, including Internet protocol (IP) address, log-in information, operating system and platform;
2. (ii) details of transactions, such as purchases and payments made on our Site or in our App; and
3. (iii) information about your visit, including URLs, date and time, pages or features viewed, response times, errors, length of visits and how you leave the page.

1.2 We retain that information for so long as the law permits. Data may be archived for as long as the purposes in Clause 2 remain valid.

1.3 Motok is meant for school-age students and should be used with a parent or guardian. We do not knowingly collect a child’s Personal Data without that adult’s involvement. If you believe we hold a child’s data without proper consent, write to admin@prosperous-nation.com and we will look into it.

2 Uses made of the information

2.1 We use information held about you for the following purposes:

(a) providing, improving and developing our services, including Motok’s conversation, scene practice and pronunciation feedback;
(b) researching, designing and launching new features or products;
(c) presenting content and information on our Site and our App in a way that works for you and for the device you use;
(d) providing you with alerts, updates, materials or information about our services, or other information you requested or signed up to;
(e) complying with laws and regulations applicable to us in or outside of Hong Kong;
(f) responding to or taking part in legal proceedings, including seeking professional advice;
(g) direct marketing (see Clause 2.2 below);
(h) communicating with you and responding to your questions or requests; and
(i) purposes directly related or incidental to the above.

2.2 We may use your personal data for direct marketing. We need your consent specifically for this purpose, and you may opt out at any time. For this clause:

(a) the personal data that may be used in direct marketing are those you provide to us or that we collect from you under Clause 1.1;
(b) the products or services that may be offered or advertised are Motok and our other products or services, events, and those of our affiliates or business partners where relevant to language learning or Motok;
(c) the information may be sent by electronic message, email or in-app message;
(d) you may opt out at any time by emailing us at admin@prosperous-nation.com. We will stop sending you marketing information without charge.

3 Disclosure of your information

We will keep the personal data we hold confidential, but you agree we may provide information to:

(a) any member of our group, meaning our subsidiaries, our ultimate holding company and its subsidiaries, if any;
(b) personnel, agents, advisers, auditors, contractors, financial institutions, and service providers in connection with our operations or services, including hosting, payment, model and speech providers used to run Motok;
(c) our overseas offices, affiliates, business partners and counterparts (on a need-to-know basis only);
(d) persons to whom we are required to make disclosure under applicable laws and regulations in or outside of Hong Kong; or
(e) actual or proposed transferees of our operations (or a substantial part of them) in or outside of Hong Kong.

We do not sell personal data.

4 Cookies

4.1 This company website is a static brochure and does not itself set cookies. Motok and any future logged-in areas of our Site or App may use cookies or similar technologies to distinguish you from other users, to keep a session open, and to help us improve the Platform.

4.2 A cookie is a small file of letters and numbers stored on your browser or device if you agree to the use of cookies. Cookies contain information that is transferred to your device.

4.3 We may use persistent cookies and session cookies. A persistent cookie stays in your browser and can be read when you return. A session cookie lasts only for the session (usually the current visit or browser session).

4.4 Where Motok or our Site uses cookies, they may include:

(a) Strictly necessary cookies — required for the Platform to operate, for example to stay signed in or complete a payment.
(b) Analytical / performance cookies — to recognise and count visitors and see how the Platform is used, so we can improve it.
(c) Functionality cookies — to recognise you when you return, for example language or region preferences.
(d) Targeting cookies — if we use them, to record visits and pages viewed so we can make the Platform more relevant. We do not currently run advertising pixels on this company website.

4.5 You can block cookies in your browser. If you do, you may not be able to use all parts of the Site or App.

4.6 We may use third-party web services on our Site or App. Those providers may use cookies, server logs or similar tools. Information collected that way (including IP addresses) is disclosed to those providers. This company website loads typefaces from Bunny Fonts, which may see your IP address and browser details when a page is opened. Our hosting provider may keep ordinary server logs for security and operations.

5 Third-party sites

Our Site, our App or our communication with you may contain links to third-party websites over which we have no control. Those sites have their own practices and policies. We encourage you to read them. We accept no responsibility or liability for the practices of third-party websites.

6 Security

6.1 Information you provide to us is stored on secure servers.

6.2 Payment transactions, where offered, will be encrypted using TLS/SSL technology.

6.3 If you have a password to access parts of the Site or App, you are responsible for keeping it confidential. Do not share it.

6.4 We restrict access to personal information to employees, service providers and contractors on a need-to-know basis and require them to keep it confidential.

6.5 We review our collection, storage and processing practices from time to time to guard against unauthorised access or use.

6.6 Transmission of information over the Internet is not completely secure. We will do our best to protect your personal data, but we cannot guarantee complete security of data transmitted to our Site or App; any transmission is at your own risk.

7 Data transfer

7.1 Data we collect from you may be transferred to, and stored at, a destination outside Hong Kong. It may also be processed by persons referred to in Clause 3 who operate outside Hong Kong, including providers of hosting, models or speech technology used by Motok.

7.2 By submitting your personal data you agree to this transfer, storing or processing outside Hong Kong. We will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.

8 Your rights

8.1 You have the right to:

(a) check whether we hold personal data about you;
(b) access any personal data we hold about you; and
(c) require us to correct any inaccuracy or error in any personal data we hold about you.

8.2 A request under Clause 8.1 may be subject to a small administrative fee to meet our cost of processing it, unless the change is needed to correct our own clerical or input error. Send requests to admin@prosperous-nation.com. We may need to confirm your identity.

9 Changes to our privacy policy

We may amend this Policy from time to time by posting the updated Policy on our Site. Continuing to use our Site and our App after the changes take effect means you agree to be bound by the revised Policy.

10 Languages

If there is any discrepancy between the English and Chinese versions of this Policy, the English version prevails.
